LOADING AND UNLOADING ORDINANCE OF THE MUNICIPALITY OF BALUNGAO, PANGASINAN, INCLUDING THE IMPOSITION OF PENALTIES FOR VIOLATION THEREOF.
ARTICLE I
Section1. TITLE- This Ordinance shall be known as THE LOADING AND UNLOADING ORDINANCE OF THE MUNICIPALITY OF BALUNGAO, PANGASINAN AND PROVIDING PENALTIES FOR VIOLATION THEREOF:
Section 2. PURPOSE OF ORDINANCE – In order to contain, if not eliminate the causes of traffic obstruction, for the protection and convenience of both motorists and commuters, there is a need to establish and organize a common and unified loading and unloading zones in the municipality of Balungao, Pangasinan.
ARTICLE II
DEFINITION OF TERMS
Section 3. This section shall be known as the definition of terms.
a. LOADING OR UNLOADING ZONE – are areas designated whereby motor
vehicles stop to discharge passengers or to take waiting passengers, or to a small quantity of freight with reasonable dispatch.
b. NATIONAL ROAD – roads and thoroughfare under the jurisdiction of the
National Government.
c. PROVINCIAL ROAD- Roads and thoroughfares under the jurisdiction of the Provincial Government.
d. PARKING – the standing vehicle, whether occupied or not, otherwise than
temporarily for the purpose of and while actually engaged in loading or unloading either freight of passengers.
e. INTERSECTION – the area embraced within the prolongation, or connection
of the lateral boundary lines of the road ways to of 2 highways joining at any
other angle may come in conflict.
f. DRIVER – a person who drives or is in actual physical control of the vehicle.
j. PUBLIC UTILITY VEHICLES – includes any vehicle such as jeepneys, buses
and motorized tricycle offered for hire to general public.
ARTICLE III
LOADING AND UNLOADING ZONES
Section 4. – THE FOLLOWING PLACES SHALL BE DESIGNATED AS LOADING AND UNLOADING ZONES, TO WIT:
a. FOR TRICYCLE – all tricycles coming from different barangays of the
municipality shall load and unload inside the Balungao Public Market
(designated loading and unloading areas).
b. PASSENGER JEEP/PUV
i) From Umingan to Rosales, Pangasinan shall load and unload in front of the Balungao Public Market “Lennong ti Pasahero,” along the National Road, with a maximum time period of Two (2) Minutes, and in front of the residential house of the late Dr. Triumfo R. Magpali, along national road, Poblacion, Balungao, Pangasinan.
ii) From Rosales to Umingan, Pangasinan shall load and unload near the water refilling station before the Saint Joseph Parish Church along national road with no required time period and in front of Macro Cooperative building up to waiting shed of Balungao National High School, National Road, Poblacion, Balungao, Pangasinan.with a maximum time period of two (2) minutes.
ARTICLE IV
PROHIBITED ACTS
Section 5. The following listed hereunder are the prohibited acts, to wit:
a) Loading and Unloading outside the designated zones provided under this Ordinance.
b) Parking at any place where official signs have been erected prohibiting the same act.
c) Loading and Unloading more than the allowable time provided under this Ordinance.
d) Any prohibited acts as may be hereinafter promulgated by the Sangguniang Bayan.
ARTICLE V
PENALTY AND OTHER PROVISIONS
Section 6. THE FOLLOWING PENALTIES ARE TO BE IMPOSED FOR VIOLATIONS OF THIS ORDINANCE.
FIRST OFFENSE – fine of Three Hundred Pesos (Php 300.00)
SECOND OFFENSE – fine of One Thousand Pesos (Php 1,000.00)
THIRD OFFENSE – fine of Two Thousand Pesos (Php 2,000.00) or six (6) months
Imprisonment or both upon conviction by court of competent
Jurisdiction.
Section 7. VIOLATORS apprehended may voluntarily pay the fines to the municipal
Treasurer or his representative who is required to issue Official Receipt/s as proof of payment.
Section 8. – IMPLEMENTING AGENCY – all authorized personnel of the PNP, CVO’s
and all others who maybe deputized by the Local Chief Executive.
Section 9. – REPEALING CLAUSE- all ordinances or any part/s thereof which are
Inconsistent with any provisions of this Ordinance are hereby repealed and/ or modified accordingly.
Section 10. – This Ordinance shall take effect upon its approval
This Ordinance shall take effect immediately upon its approval and publication.
